Anytime General Terms and Conditions

Introduction
These terms and conditions describe the contractual relationship between the Holder of an Anytime Account (you) and ANYTIME SA,
They are concluded between:
The Holder of a payment account open with Prepay solutions or Treezor and using the Services made available by ANYTIME, hereinafter referred to as the "Customer"; and
ANYTIME SA, a public limited company with a capital of 378 030 euros registered under the number 0846.315.003 in Belgium. Our head office is located at 326 Avenue Louise, 1050 Brussels.
It is hereinafter referred to as "Anytime".
The Services user agreement is made up of these General Terms and Conditions and of the Terms and Conditions of the Customer Area. The customer area is your user interface. In this way, you can access all the Anytime Account Services with a computer, a mobile, a tablet or another device, whether with the aid of a search engine or the help of one of our applications. You can consult the Terms and Conditions of the Customer Area
These terms and conditions are applicable to all the ANYTIME Services accessible via the Anytime Account, which you ("user","you") can use through the mobile application ("app") or the user interface provided by Anytime, accessible at: https://www.anyti.me ("site")
By subscribing to the Services offered by Anytime through partners ("services"), you also subscribe to the terms and conditions or conditions of use of these partners.
In the event of contrary services, the terms and conditions of Anytime will override those of the Customer area and the general conditions of sale or use of Services unless stated otherwise.
You remain bound by the general conditions in the event of termination of general conditions of sale or use of Services except to enter also in the case of termination of current general conditions.
Anytime SA is agent of the following financial institutions
We have the status of agent of the following financial institutions and have been declared as such with the supervisory authorities:
- Prepay Solutions (PPS EU): PPS EU, means a company registered in Belgium under the number 0712.775.202 nd whose address is boulevard du Souverain 165, boite 9, 1160 Bruxelles, Belgique. It is regulated by the National Belgium Bank (NBB) as an issuer of electronic money and registered under number 0712.775.202. PPS issues MasterCard prepaid cards. Anytime acts as an agent.
- Treezor is a simplified joint-stock company with a share capital of € 2,250,000, registered in the Nanterre Register of Commerce and Companies under number 807 465 059, whose registered office is at 150 rue Gallieni in Boulogne Billancourt (92100), acting as an electronic money institution and approved by the Prudential Control and Resolution Authority ("ACPR") under number 16798. Anytime acts as agent and proposes the Treezor Payment Accounts, as well as the related payment services .
We also offer services through the following partners:
International transfers
Currency Cloud, a limited liability company registered in the United Kingdom under number 06324658 and domiciled, Stewardship Building 1st Floor, 12 Stewart Street, London, England, E1 6FQ.
Credit card payments through a payment terminal
SumUp Payments Limited, 32 - 34 Great Marlborough St, W1F 7JB, London, UK registered in the United Kingdom under number 0783 6562.
Credit card payments through a web site or a payment link
Checkout - 1st Floor, 32 Wigmore Street, W1U 2RP, London,UK, registered in the United Kingdom under number ZA071209.
Definitions
"You" means the customer
"Us" means Anytime
"Working day" means Monday to Friday excluding holidays in Belgium. The general conditions of use of our partners may refer to different business days depending on the Services concerned. These shall prevail over the public holidays referred to herein.
«Services» Services offered by Anytime live or via partners
"Account" or "Account Anytime" means all the Services available through your Customer Area and distributed by Anytime.
"Card" means the prepaid card distributed by Anytime
"Holder" means the person signing the Treezor or Prepay Solutions framework agreement entitled to the "Payment Account" service
1. Field of application of the contract: Anytime Services
1.1 The object
The purpose of this contract is to define the terms and conditions of use of the Anytime Services offered via your Customer Area. You can use and manage your Services through the Customer Area. Each of our Services is attached to the General Conditions of Sale or Use of our partners as described below.
1.2 You are an individual customer
1.2.1 Service: Payment account
The use of a payment account and associated payment services implies the acceptance of the General Conditions of the partner as described below:
IBAN number beginning with FR: accepting the General Terms and Conditions of the Treezor Account
- Treezor provides the following payment transactions:
- Payment account credit by acquisition of a card payment order
- Credit of the payment account by acquisition of a payment order by transfer
- Credit of the payment account by acquisition of a payment order by debit
- Debit of the payment account by execution of a transfer order
- Debit of payment account by execution of a debit order
- Debit of the Card Account by execution of a card payment order.
IBAN number beginning with BE: accepting of Terms and Conditions PrePay Solutions
Prepay Solutions provides the following payment transactions:
- Payment account credit by acquisition of a card payment order
- Credit of the payment account by acquisition of a payment order by transfer
- Debit of the payment account by execution of a transfer order
- Throughput of the Card Account by execution of a card payment order
1.2.2 Service: Provision of a Mastercard
The use of a Mastercard payment card distributed by Anytime implies the acceptance of the Terms and Conditions of the partner as described below:
- Your card number begins with 5469 23 accepting the Treezor Terms and Conditions of the Card
- Your card number begins with 5342 282X accepting the Terms and Conditions PrePay Solutions
- Mini card Mastercard with contactless to insert in a bracelet or a key holder accepting the Terms and Conditions Prepay Solutions of the card
1.3 You are a Professional customer
1.3.1 Service: Payment account
The use of a payment account and related payment services implies acceptance of the partner's general terms and conditions as described below:

- Treeor provides the following payment transactions:
- Payment account credit by acquisition of a card payment order
- Credit of the payment account by acquisition of a payment order by transfer
- Credit of the payment account by acquisition of a payment order by debit
- Debit of the payment account by execution of a transfer order
- Debit of payment account by execution of a debit order
- Debit of the Card Account by execution of a card payment order.
IBAN number beginning with BE: acceptance of the General Terms and Conditions Prepay Solutions
- Prepay Solutions provides the following payment transactions:
- Payment account credit by acquisition of a card payment order
- Credit of the payment account by acquisition of a payment order by transfer
- Debit of the payment account by execution of a transfer order
- Throughput of the Card Account by execution of a card payment order.
1.3.2 Service: Provision of a Mastercard payment card
The use of a mastercard payment card distributed by the Anytime account implies acceptance of the partner's terms and conditions as described below:
- Your card number begins with 5314 42XX accepting the Treezor Terms and Conditions of the Card
- Your card number begins with 5342 283X accepting the Terms and Conditions Prepay Solutions
- Virtual MasterCard number acceptance of Terms and Conditions Prepay Solution VCN Single
1.3.3 Service: Provision of a payment terminal
Anytime distributes Sumup payment terminals, their use implies acceptance of the Sumup Terms and Conditions
2.Subscription of a service
2.1 You may open an Account on the condition that you are at least 18 years of age and resident in one of the countries mentioned in the registration form available on the online interface at the time of the subscription.

3.Open an Account
3.1 When opening your Account, we will ask you to choose a username (your "Username"), consisting of a Login (your valid email address) and a password.
You are entirely responsible for maintaining the confidentiality of your User ID. You agree to immediately notify Anytime in the event that you suspect unauthorized use of your Account or access to your User ID. You are solely responsible for any use of your Account
3.2 Third party PSPs may have access to your Account if you have given them permission. We have an obligation to allow access to your third party PSP unless we suspect unauthorized or fraudulent access. In this situation, we will inform you of the reasons for this denial of access if possible before access is denied or immediately thereafter unless this information is not reportable for reasons of objectively justified security or its communication is prohibited by a provision of the European Union or of relevant French law. We will give access to your account to third party PSPs as soon as the reasons justifying the blocking no longer exist.
4. Fight against fraud, money laundering and the financing of terrorism
In the light of anti-money laundering and anti-money laundering legislation and regulations and the financing of terrorism, we need to know our clients. The subscription of a financial product or service is therefore conditional on the provision of documents enabling us to verify the identity of our customers.
The documents that will be requested when you subscribe to ANYTIME services are specified in the T&C of our partners (accounts and cards). Please note, this list is not exhaustive and we reserve the right to refuse the subscription in accordance with article 6.2 of these general conditions.
We reserve the right to refuse your subscription due to an incomplete file or if we encounter difficulties in verifying your identity.
Legislation and regulations may require us to request additional information or documents during the course of the business relationship.
5. Types of operations and services
linked to your Account
5.1 How to load your Payment Accounts or Cards ?
- by bank transfer on the IBAN which has been communicated to you by ANYTIME
- by check in your name or on behalf of the company for Professional Accounts
- by a credit card payment transaction
Cash is not allowed.
5.2 Payment Transaction
You can order a payment transaction from your Account:
- Either by using Mastercard or Visa
- Either in the context of a SEPA or international transfer
- Or in the context of a face-to-face payment with the beneficiary, via a QR code
- Or as part of a transfer from an Anytime account to another Anytime Account
5.3 Collection Process
- By accepting payments in euros (€) by bank transfer by communicating the IBAN attached to your Account.
- By cashing checks in euros (€) in your name or in the name of your professional activity: the methods of feeding by check are described in your Customer Area. In any case, the number of checks cashed is limited to 5 per month and the maximum amount per check authorized is 1500 euros
- Via the Payment Terminal: you turn on the payment terminal provided by Anytime and you follow the instructions.
- Face-to-face: Simply scan the QR code of the Anytime Account related to the person you want to cash in. The transaction is confirmed instantly.
- - Remotely via the Anytime App: you indicate the amount you want to collect, you identify the person to be cashed using his mobile number or his mail. This can be paid to you in 3 ways
- by Wire Transfer
- By entering the details of his/her credit card
- By transferring money from your Anytime Account to your Anytime Account.
5.4 Collection operation
This feature is available only for Holder who has an Anytime account linked to an FR IBAN and has accepted the T&C from Treezor.
A prize pool allows you to raise funds from participants (people who use Anytime without necessarily being an Anytime "Participant (s)" client) to fund, for example, a gift, an event, a common evening, support a cause (hereinafter referred to as the "Pool"). Only Individuals can create Jackpots.
You are solely responsible for the information provided in the Prize Pool and you agree not to mislead the Participants by indicating descriptions that do not conform to reality or impersonate a person.
Participants are invited to contribute to La Cagnotte by means of an SMS or an e-mail containing a hypertext link to obtain all the details of the prize pool (amount, description, duration, economic beneficiary)
The Participants requests that you collect the funds on their behalf and use the funds raised to finance the project described in the Pool.
Anytime reserves the right, without motivation, nor right to indemnification, to remove any Jackpot who does not respect the law or good morals.
The Participants have given you a mandate under which you are responsible for the use of the collected funds. If you use the funds in a manner which does not conform to the purpose of the Prize Pool, the Participants will be entitled to retaliate against you and you agree to settle all disputes. In no event shall Anytime's liability be incurred.
5.5 Refund Transactions
You can ask an individual to whom you have advanced an amount to refund you. You must indicate the amount that the individual must reimburse to you and send a refund request via your Customer Area.
Under no circumstances can this functionality be used for payment functions. Anytime reserves the right to remove the refund functionality of your Account without indemnity if it is not used in accordance with its purpose.
6. End of contract and reimbursement
In the event that no transaction is recorded on your account for a period of 6 months, your account will be closed without refund.
6.1 By accepting these Terms and Conditions, when you order a plastic card, you expressly waive your right of withdrawal which can be exercised for 14 days.
6.2 We may refuse your contract in cases where the legal examination of the documents provided for the opening of your Account does not allow us to finalize the subscription in accordance with our legal and regulatory obligations.
In the event that a legal review of your file occurs during the course of the contract due to a change in the regulations, a change in your situation or financial partners investigations (PPS or Treezor), the annual management fee for your Account and your card will not be refunded.
6.3 We reserve the right to terminate access to our Services without prior notice or notification in the following situations:
- We suspect an illegal or fraudulent use of your Account,
- We suspect a use of your Account for money laundering or terrorist financing purposes.
- You use our Services in an irregular manner as described in section 8.4.
In these situations, a fee may apply in accordance with Article 10.
6.4 We reserve the right to terminate access to our Services with two months notice if we find that the use made of it does not correspond to a use "in good stead (the best interests) of the family" or does not correspond to the nature of the service you have subscribed to or is not adapted to your needs (constant complaint to the customer service, inability to receive SMS or email sent by Anytime, messages systematically posted on social networks in order to damage the reputation of Anytime or to make Anytime react, lack of understanding of the French or English language ...). In the latter case, we can propose you to switch to a suitable service. Fees may apply in accordance with Article 10
6.5 Any termination decided by Anytime will be notified to you by email.
6.6 You may withdraw from your contract at any time.
6.7 In the event of termination, we are required to refund the amounts shown on your Account and your Card (s). The refund will be made by credit to your bank account (provision of a RIB on behalf of the account holder for individuals and in the name of the business for the professionals) If you do not provide us with the RIB requested before the closing date indicated, the Account will be closed. You can claim your account balance for 6 years after that date.
6.8 In the event that your Account has a negative balance on termination, you will be required to repay the debt as soon as possible. Otherwise, we reserve the right to use all legal means to obtain payment of this debt.
6.9 In the event that no transaction is recorded on your account for a period of 6 months, your account will be closed without refund.
7. Language of contract and communication
French is the language of contract and communication.
8. Use of our Services
We identify you as the Account or Cardholder and you alone are authorized to perform transactions using authentication instruments.
8.1 Custom security features. When you subscribe, you must choose your login credentials. This is a unique combination: email address and password with which you can connect to the Customer Area and create a PIN that allows you to make transactions on demand ("custom security features").
8.2 The cards sold by Anytime are systematically authorized debit cards. Overdrafts are not allowed on your Account. Ensure that your Account and Card are sufficiently stocked before making a payment, transfer, or cash withdrawal. Fees may be charged to you for failure to provide your Account or Card in accordance with Section 10 hereof.
8.3 We may be required to pay transactions in excess of your Account balance. In this case, you will have to make a transfer to your Account as soon as possible in order to reduce the balance of your Account to a positive or zero position. Otherwise, we reserve the right to use all legal means to recover our debt.
8.4 You agree to use our Services on a regular basis in accordance with these terms and conditions and the law. You also agree to behave correctly in connection with customer service. Failing this we reserve the right to charge you the fees described in paragraph 10 and we reserve the right to terminate your Account under the conditions provided for in article
9. Confidentiality of custom security features; secure storage of the authentication instrument
You agree to keep your personalized security features secret and to keep your authentication instrument secure. Custom security features and the authentication instrument must be protected from third-party access.
10. Fees and Payment
The rates for our Services are set out in Pricing Conditions
These fees are subject to change at any time, subject to notification and notice of at least 2 months
- Payment of fees is made at the time of subscription:
- or by credit cards: Visa, MasterCard, other bank cards (eCard blue) with 3D Secure.
- or by bank transfer.
Either by debiting your Anytime Account.
In case of payment by bank transfer, the order will be processed only on the date of receipt of the funds.
Payment of fees is made during the use of the Account:
- or by debiting on your Anytime Account if it is sufficiently supplied. If your Anytime Account has an insufficient balance to collect the subscription, it will be blocked. All you have to do is credit your Account or your card to allow the subscription to be withdrawn and unblock your access.
- or by bank transfer.
- or by credit or debit card.
In case we can not debit your Anytime account due to insufficient balance, we will debit your bank account or your credit card used for the subscription process.
Any new subscription period begun is due in full. The anniversary date is always calculated relative to the subscription date, not the date of payment of the subscription.
If you have subscribed to an annual rate plan and you decide to stop using our services, no refund, even pro rata temporis will be made. If you have subscribed to a monthly rate plan, any billed period will not be refunded, including the administration fees applied for registration.
11. Telephony and data transfer charges
Depending on the tariff agreed with your telecommunications provider, you may incur additional charges for data transfer. You will have to bear these costs that will be charged to you by your telecommunications provider.
12. Confidentiality and notification obligations
You are required to provide us with your correct personal data, in particular your name, address, date of birth, telephone number and e-mail address and to notify us of any changes as soon as possible.
Please inform us immediately of any loss or theft of your card, authentication instruments, personalized security features, or improper or unauthorized use by logging into your Anytime customer account and declaring the lost or stolen card in the relevant heading.

Belgium: You can contact customer service at 02 290 56 13 between 9 am and 6.30 pm from Monday to Friday (working days).
France: You can contact the customer service on 01 73 600 632 (individuals) or 01 73 600 634 (professionals) between 9 am and 6.30 pm from Monday to Friday (except Saturday, Sunday and public holidays).
13. Cases of blocking the card or access to our Services
13.1 Blocking access to our Services
If we have reason to suspect unauthorized use of your Account or fraudulent use, we are entitled to block or limit access. We will inform you as soon as possible by e-mail or SMS. Similarly, we will also block your Account if you notify us of similar activities. We will lift the blocking or limitation if the reasons for blocking have ceased to exist.
Only the Account Manager or the Cardholder for individuals may be held liable for fraudulent, malicious or otherwise violations of these terms and conditions of the Account or Cards.
13.2 Blocking of funds
If we have reason to suspect unauthorized use of our Services or fraudulent use, we reserve the right to block funds on your Account. We undertake to release them if suspicion of unauthorized use or fraud is lifted. In any event, the blocking of funds will not exceed 120 days.
13.3 Blocking your Card
You have an option to block and unblock your card independently from the Account in your Customer Area. This blocking ability was set up to be temporary.
13.4 Theft or fraudulent use of your card
In case of theft or fraudulent use of your card, you must notify us as soon as possible by email and you must declare your stolen card in your Customer Area. You can request that a new card be sent to you free of charge.
You will be asked to fill out a form for challenging fraudulent transactions. We refer you to the terms and conditions of use of the cards for the terms of reimbursement of these transactions.
13.5 Loss of your Card
In the event of the loss of your card, you must notify us as soon as possible by mail and you must declare your lost card in your Customer Area. You can ask for a new card in your Customer Area. In this situation, the renewal is billed to you. We refer you to our price list for the fees attached to this new card.
14. Changes to these Terms and Conditions
You will be notified of any changes to these terms and conditions at least two months before the proposed date of enforcement. You will be deemed to have given your authorization if you have not notified your refusal before the proposed date of the enforcement of these amendments.
If you do not accept the changes, you can terminate your contract until the effective date of the changes.
15. Complaints
15.1 In case of complaints, these must be addressed:
- for individuals: by writing to us via your customer access
- for professionals: by writing to us via your customer access
15.2 We will send you a written confirmation within five working days and will inform you of the action taken until your complaint has been resolved.
In situations where it is not possible to settle the dispute by this means, an internal mediation service is at your disposal at the following e-mail address: reclamation@anyti.me
15.3 If you are an Anytime customer, you can file a complaint through the European Online Dispute Resolution Platform at http://ec.europa.eu/consumers/odr/
16. Applicable law
The jurisdiction of the court to be addressed depends on the domicile of the natural person or the registered office of the legal person. French law governs Anytime's general conditions for customers who have a domicile in France or whose registered office is in France. Belgian law governs the general conditions of customers who do not have a domicile in France or whose registered office of the company is not in France
17. Force majeure
19.1 Anytime shall not be liable for any breach of its obligations hereunder if such breach results from an external event beyond its reasonable control and not resulting from its fault or negligence, state of war declared or not, transport unrest, natural calamities, civil unrest, acts of terrorism, legal or regulatory restrictions and, more generally, any event of force majeure according to the criteria adopted by the jurisprudence.
19.2 Anytime can not be held liable for malfunctions of the network
Internet or computer and telecommunication networks but will do everything possible to restore the situation as if the malfunctioning had not taken place and this will be soon as possible.
